Your use of the software, website and services (referred to as “SmartPortfolio”
in this document) provided by Smart Financial Services (ABN 16 414 650 755) is
subject to these Terms and Conditions.
NON-ADVISORY SERVICE
No information on the SmartPortfolio website, nor any emails generated by the SmartPortfolio system is to be considered as financial advice. You are responsible for the
data you enter into SmartPortfolio and are therefore responsible for the results that SmartPortfolio returns to you.
ADVERTISING
SmartPortfolio may from time to time include advertisements in emails sent to members or on the website itself.
Our policy is that we will never send you more than two advertisement offers by
an email initiated from us (ie. email message that you did not request to be
sent to you)
within any 30 day period. We may include up to one advertisement per email and
no more than three advertisements per week in the footer of the 'daily portfolio
update' emails sent to you. You may elect to have your account completely
Ad-Free for a year by upgrading your user account to Premium status. Unless otherwise explicitly stated, SmartPortfolio does not endorse nor does it recommend the use of
any advertisers' products or services.
CHANGES TO T&C
SmartPortfolio reserves the right to update these Terms and Conditions at any time and make them publicly available on this page.
PRIVACY
We respect your privacy and collect information only required to offer you
this service, any personal information offered by you is done so at your own
discretion. Personal information is used only for the purpose it was provided to
us for. SmartPortfolio will never offer your personal information, including
your email address to any third party, contractor or affiliate of. Please refer to our Privacy Policy for more information.
LIMITATION OF LIABILITY
You expressly understand and agree that the SmartPortfolio shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if SmartPortfolio has been advised of the possibility of such damages), resulting from:
- the use or the inability to use the service;
- the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service;
- unauthorised access to or alteration of your transmissions or data;
- statements or conduct of any third party on the service; or
- any other matter relating to the service.
DISCLAIMER OF WARRANTIES
You expressly understand and agree that your use of the service is at your sole risk. The service is provided on an "as is" and "as available" basis.
SmartPortfolio expressly disclaims all warranties of any kind, whether expressed or
implied, including, but not limited to the implied warranties of merchantability, fitness for a particular
purpose and non-infringement and makes no warranty that:
- the service will meet your requirements;
- the service will be uninterrupted, timely, secure, or error-free;
- the results that may be obtained from the use of the service will be accurate or reliable;
- the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations; and
- any errors in the software will be corrected.
While best efforts are made to ensure the correctness of mathematical
formulas, algorithms and general web programming, we make no guarantee of
its accuracy.
Any material downloaded or otherwise obtained through the use of the service is done at your own discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.
No advice or information, whether oral or written, obtained by you from the SmartPortfolio or through or from the service shall create any warranty.
RIGHT TO REFUSE SERVICE
SmartPortfolio reserves the right to refuse service to anyone (paying or not) if SmartPortfolio believes beyond reasonable doubt that that person is using the SmartPortfolio for any other reason that originally intended to be used for.
